Uzbek President signs law “On operative-search activity”
Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Islam Karimov signed a law “On operative-search activity” on 25 December 2012.

Legislative Chamber passed the law on 7 November 2012, and Senate passed the document on 5 December 2012. The law will come into force 12 months later.

The document is aimed at creative legislative and legal framework for operative-search activity of law enforcement bodies, as well as legal guarantees of adhering to rights and freedoms of the citizens at operative-search operation.

The law allows to systematize norms in several legislative acts, which regulates operative-search activity and raise quality of inquiry and preliminary trial, effective measures on preventing violations, democratization of judicial-legal system and liberalization of law enforcement bodies’ activities.

The document consists of 5 chapters and 31 articles. The law said that operative-search activity is conducted by state bodies, authorized by the law.

Ministry of Interior Affairs, National Security Service, State Customs Committee, Department of fighting tax, currency crimes and legalization of crime income under the Prosecutors’ Office can conduct operative-search activities in Uzbekistan. Other state bodies, legal entities and individuals cannot carry out operative-search activities.

The main goal of the operative-search activity is to protect rights, freedoms and interests of people, property of legal entities and individuals, security of people, public and government, prevent and reveal crimes, and find out criminals.

The law said that law enforcement bodies, which conduct operative-search activity, should adhere to rights, freedoms and interests of people, the law said.

If the law enforcement bodies violate rights and freedoms of people, their heads should adopt measures to revive their rights and freedoms and punish violators.

The law enforcement bodies cannot use information, revealed during operation-search operation, which are not related to the case, to limit rights or freedoms of people.

No one shall be subjected to torture, or other cruel or humiliating or degrading treatment, the law said. It added that operative-search activities, which are banned by legislation, cannot be carried out.

Law enforcement bodies cannot attract to cooperation MPs, Senators, judges, prosecutors and lawyers in confidential mode.

Prosecutors’ Office will supervise execution of the law during the operation-search activities in Uzbekistan.
