Uzbekistan tightens intellectual property protection

Tashkent, Uzbekistan (UzDaily.com) — The President of Uzbekistan has signed a new law introducing amendments to the legislation on intellectual property protection.

Key Changes:

- Introduction of Compensation for Infringement: For the first time, a procedure for compensation for the illegal use of intellectual property has been introduced, increasing the responsibility of infringers.

- Amount of Compensation: The rights holder can claim compensation ranging from 20 to 1000 Basic Calculated Values (BCV) from the infringer, regardless of the actual damages incurred.

- Determination of Compensation: The amount of compensation will be determined by an agreement between the parties or by the court, taking into account the nature of the infringement, the degree of fault, and commercial practices.

Advantages of the New Law:

- Enhanced Legal Protection: The new compensation system tightens responsibility for intellectual property violations and strengthens the protection of rights holders.

- Encouragement of Innovation: More stringent protection of rights will foster innovation and stimulate investment in intellectual property.

- Alignment with International Standards: The introduction of compensation for rights violations aligns with international standards in intellectual property protection.

The law will come into effect three months after its official publication, providing time for rights holders and infringers to familiarize themselves with the changes.

The new rules introduced by the law will allow for more effective protection of intellectual property in Uzbekistan and enhance the country's attractiveness to foreign investors.
