Uzbekistan strengthens responsibility for violating land use legislation

Tashkent, Uzbekistan (UzDaily.com) —  During the recent plenary session of the Senate, the Law "On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan Aimed at Improving Mechanisms for the Effective Use of Land Plots and Preventing Offenses in This Area" was discussed.

In recent years, significant efforts have been made to promote the rational and effective use of land. As a result, there has been a fundamental shift in the population’s attitude towards land.

However, some deficiencies remain in this area, necessitating further improvement of the legislation, which led to the development of this Law.

The Law introduces several changes and additions to current practices.

In particular, it strengthens measures of administrative and criminal responsibility for actions that violate land legislation.

It is established that crimes such as the illegal seizure of land plots will be investigated solely by prosecutorial authorities. Previously, such crimes were also investigated by investigators from the internal affairs bodies.

The Economic Code and the Civil Procedure Code are supplemented with provisions establishing special procedures for cases involving the return of illegally seized land plots that are state property, as well as the demolition of unauthorized constructions.

Moreover, local executive authorities are exempt from state duties when filing lawsuits for violations of land legislation in civil and economic courts.

During the discussions, it was noted that the adoption of this Law would enhance the effectiveness of combating offenses related to land plots and facilitate the timely recovery of damages caused by these crimes.

Following lively discussions, the Law was approved by the senators.
