Uzbekistan increases penalties for illegal tree cutting

Tashkent, Uzbekistan (UzDaily.com) -- At the forty-eighth plenary meeting, senators considered the Law “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan.”

In recent years, large-scale work has been carried out in the republic to plant trees in populated areas, protect trees and shrubs, and expand green areas.

These include the implementation throughout the country of the national project “Yashil Makon”, aimed at increasing tree plantations, as well as the introduction of a moratorium on the cutting down of valuable species of trees and shrubs.

However, aggressive actions of individuals in relation to objects of the plant world, including cases related to the facts of illegal cutting of trees, are the reasons for the deterioration of the general environmental situation.

At the same time, the existence of several types of administrative liability for felling, felling, damage or destruction of trees and shrubs hinders the formation of a unified law enforcement practice in this regard and causes various problems.

In this regard, in the Code of the Republic of Uzbekistan on administrative liability establishes administrative liability for the development of project documentation leading to cutting down, uprooting, damage or destruction of valuable species of trees and shrubs.

Administrative penalties for illegal cutting, uprooting and damage to trees are also being strengthened and duplicative regulations are being eliminated.

In addition, the Law of the Republic of Uzbekistan “On the Protection and Use of Flora” establishes the obligations of persons who have illegally cut down or destroyed valuable species of trees and shrubs not included in the state forest fund to plant compensatory seedlings of trees and shrubs instead of illegally cut down and destroyed trees and shrubs, in the place where the cut down and destroyed trees and shrubs sprouted and take care of them for three years.

At the same time, the Law stipulates the application of financial sanctions to legal entities for illegal cutting or destruction of valuable species of trees and shrubs.

It was noted that the Law serves to prevent administrative offenses related to illegal logging, uprooting, damage or destruction of trees and shrubs, increase the liability of individuals and legal entities, as well as the formation of a unified law enforcement practice in this area.

At the end of the discussion, the Law was approved by the senators.
