Tashkent, Uzbekistan (UzDaily.com) – Bashkir Soda Company JSC, located in the Republic of Bashkortostan, Russia, is the copyright holder of the collective trademark “Baking Soda”, registered internationally on February 10, 2015, No. MBX1242730. According to the testimony, the use of this trademark also extends to the Republic of Uzbekistan. This was reported by the press service of the Committee for the Development of Competition and Protection of Consumer Rights.
This enterprise submitted an application to the Committee, claiming that the appearance of the packaging of baking soda produced and sold by AZIA MATCH LLC, located in the city of Tashkent, duplicates the trademark of Bashkir Soda Company JSC, indicating a violation of legal rights to the trademark and causing damage, in connection with which the company requests to take measures in accordance with the established procedure.
During the commission’s study of the circumstances of the treatment when comparing packaging boxes of baking soda produced by AZIA MATCH LLC and Bashkir Soda Company JSC, purchased at the Carrefour store in Tashkent, a general harmony of colors was established, the uniformity of the elements of the word “Baking Soda”, the location of which similar to such an extent that the packaging is easy to confuse. This situation may give the consumer the impression that these products come from the same manufacturer.
A case was opened against AZIA MATCH LLC in accordance with the established procedure, and based on the results of the consideration of the case, the Special Commission charged AZIA MATCH LLC under Article 13 of the Law of the Republic of Uzbekistan “On Competition”, indicating a violation of the third and fourth paragraphs. Based on this decision
AZIA MATCH LLC was tasked with eliminating the situation of violation of the law and preventing a similar situation from occurring in the future. The company reported that after fulfilling the requirements according to the issued order, the unused packaging boxes were sent for recycling into waste paper and destroyed by shredding.
