The Competition Committee Orders YandexGo to Remove “Yandex Market” Advertisement Over Unfair Competition
Tashkent, Uzbekistan (UzDaily.com) — The Competition Development Committee has reviewed a complaint filed by Uzum Market against LLC YandexGo UB regarding a television and social media commercial for Yandex Market.
Following an investigation, the Committee identified signs of unfair competition, violations of the Law “On Competition,” misleading of consumers, and damage to Uzum Market’s business reputation.
The Committee’s special commission concluded that the visual and narrative elements used in the advertisement largely replicated imagery previously employed in Uzum Market’s commercials.
Particular attention was drawn to the actress’s purple dress, the opening scenes of the commercial, and the main character’s lines, which created associations with the Uzum Market brand. The phrase “No, this is another market” effectively suggested the superiority of Yandex Market over its competitor.
These actions were classified as unfair comparison, prohibited under Article 21 of the Law “On Competition.” Although no direct evidence of financial damage to Uzum Market was presented, the violation was recognized as having a low economic impact.
The commission ordered LLC YandexGo UB to remedy the violation within one month and remove the disputed commercial from all media channels. The company must provide proof of compliance by August 14. At the same time, YandexGo retains the right to appeal the decision before the Committee’s Appellate Council or through the courts.
