Powers of supervisory boards of state enterprises defined

Tashkent, Uzbekistan (UzDaily.com) – Resolution of the Cabinet of Ministers “On introducing amendments and additions, as well as recognizing as invalid some decisions of the Government of the Republic of Uzbekistan in connection with the adoption of the Strategy for the management and reform of enterprises with state participation for 2021–2025”.

In accordance with the document, government acts are supplemented by rules governing the management of state-owned enterprises, as well as the rights and obligations of the supervisory board of state-owned enterprises.

The state enterprise is a commercial organization in the form of a state unitary enterprise, formed on the basis of state-owned property transferred to it for operational management. It carries out activities in accordance with its goals, tasks of the owner or, on his behalf, the state body-founder authorized by him.

So, according to the additions:

the governing bodies of a state-owned enterprise are the founder, supervisory board and executive body (head);

the supervisory board carries out the general management of the state-owned enterprise;

the number of members of the supervisory board is determined by the charter of the state enterprise, but at the same time it cannot be less than 3 people, the composition of the members of the supervisory board must be in an odd number;

The supervisory board is appointed by the founder for 3 years.

The following powers of the supervisory board of state-owned enterprises are also fixed:

make proposals to the founder on the appointment and dismissal of the head of the state enterprise;

establish qualification (level of education, work experience in the commercial, financial or other sphere) requirements for a candidate for the position of head of a state-owned enterprise;

appoint and dismiss deputy heads of state-owned enterprises;

approve the regulation on internal audit, appoint and dismiss employees of the internal audit service of the state enterprise;

hear the reports of the head and structural divisions, as well as branches of the state enterprise, etc.
