Over 335 million soums to be returned to Central Park visitors
Tashkent, Uzbekistan (UzDaily.com) -- Today, many amusement parks in our capital operate a payment card system. Riding on the rides is carried out only with plastic cards, the ticket system is no longer valid.
A consumer contacted the Agency for the Protection of Consumer Rights, from whom funds in the amount of 60,000 soums were debited without notification from a payment card Central Park named after Mirzo Ulugbek located in the city of Tashkent. During the study of this issue by the Agency’s staff, it turned out that this problem affected several thousand more consumers, who also used the card intended for use in the park.
So whose fault: the consumer or the park administration? Why does the park administration fail to inform the consumer in a timely manner?
It is worth noting that according to the offer, the card’s validity period is indicated on the back of the payment card. After the expiration of the term, the funds of the card must be transferred to a new card within 3 days, but only after the consumer’s statement.
However, in the above situation, the validity of the consumer’s card expired 31 more last year, and without notifying the consumer about the validity of the card and the procedure for replacing them, the card was canceled. The consumer found out about this during another family walk in the park, when he could not use the card.
According to the law, namely Article 6 of the Law "On Protection of Consumer Rights", the manufacturer (performer, seller) is obliged to provide the consumer with the necessary, reliable and accessible information about the goods (works, services) sold by him in a timely manner. And also Article 21 of the Law states that the seller (performer) does not have the right to insist on the purchase of additional goods by the consumer or the provision of additional services, as well as to charge a fee for services not provided.
More than 18 thousand consumers, and the total amount is 335 610 000 soums
According to the results of the study, the Agency for the Protection of Consumer Rights found that JV LLC "Jet Invest" since 2018, 130 thousand consumers were issued payment cards, of which 18 291 were canceled upon expiration. It is important to note that the total amount was 335,610,000 soums. As the park administration noted, the problem was caused by the non-functioning of the park during the pandemic.
To date, the park administration has returned 14,872,400 soums to 643 consumers within the framework of the Agency’s instructions.
