National legal norms are harmonized with the agreements of the World Trade Organization

Tashkent, Uzbekistan (UzDaily.com) -- The country is taking appropriate measures to accelerate the process of joining the representative international organization that manages the rules of international trade - the World Trade Organization and to ensure its quality implementation.

At the forty-ninth plenary meeting of the Senate of the Oliy Majlis, the Law “On introducing amendments and additions to certain legislative acts of the Republic of Uzbekistan, providing for bringing the national legislation of the Republic of Uzbekistan into compliance with the agreements of the World Trade Organization” was considered.

To harmonize with the requirements of the World Trade Organization several norms of national legislation related to property, advertising and state duties, the law provides for amendments and additions to the laws “On inventions, utility models and industrial designs”, “On trademarks, service marks and names” places of origin of goods”, “On advertising”, “On medicines and pharmaceutical activities” and “On state duty”.

In particular, the changes made to the Law “On Inventions, Utility Models and Industrial Designs” serve to ensure the implementation in practice of inventions or utility models that have not been introduced into industrial production for years, the production of new types of products and filling the market.

In addition, the Law “On Advertising” is harmonized with the rules provided for by the General Agreement of the World Trade Organization on Trade in Services, and provides for the creation of an environment of free competition.

Based on the amendments and additions made to the Law, the restriction on advertising of beer, natural and sparkling wines produced abroad is lifted, and thereby creates the ground for the emergence of a competitive environment in the market.

Based on agreements of the World Trade Organization, additional rules are also being introduced into the Law “On Medicines and Pharmaceutical Activities”, providing for the protection of the rights of manufacturers of original medicines by introducing a mechanism for the effective protection of data obtained as a result of preclinical and clinical trials in pharmaceutical activities.

Amendments are being made to the Law “On State Duty”, aimed at carrying out the same business activities for both enterprises with foreign investment and domestic enterprises. That is, the state duty rate for state registration of enterprises with foreign investment is reduced from 10 times to 1 times the base calculated value.

In the Law, the amounts of the state fee for filing an application for a patent, conducting a formal examination and publishing information on the legal protection of inventions, utility models and industrial designs are harmonized with the requirements of the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights.

According to the senators, the adoption of this Law serves to accelerate the process of Uzbekistan becoming a member of the WTO by harmonizing national legislation with the requirements of World Trade Organization agreements, as well as ensuring the protection of intellectual property, creating the same conditions and an equal competitive environment for the Republic of Uzbekistan and foreign investors.
