Courts cannot initiate criminal cases in Uzbekistan
Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Islam Karimov signed a law “On introduction of changes and amendments to some legislative acts of Uzbekistan in connection with further reforms of judicial-legal system” on 18 September 2012.

Legislative Chamber of Oliy Majlis of Uzbekistan passed the law on 12 July 2012 and the Senate approved it on 30 August 2012. The law came into force on 19 September 2012.

The law was developed in line with the concept for further deepening democratic reforms and forming civil society in the country.

The document introduces changes to law “On prosecutors”, law “On courts”, Criminal-Procedural Code, Civil Procedural Code, Economic Procedural Code of Uzbekistan.

It envisages judicial order of use of procedural constraints such as firing from the post, placement of person to medical establishment. It also abolishes right of court to open criminal case, etc.

The law will strengthen judicial control at holding an inquest and preliminary trial, expand use of habeas corpus in criminal process, and help to strengthen guarantees protection of rights and freedoms of people in criminal process.
