Avtooyna OJSC, for example, is natural monopoly. Located in Ferghana region, the enterprise produces safe car glasses. The product has set limited profitability.

Inspection of the enterprise revealed that it violated the Law “On limiting monopoly activity at goods market and competition”. The committee said that the enterprise included discrimination terms to contract, which put counteragents to unequal position compared to other business entities. The enterprise also set too high fixed prices and maximum prices, as well as extra charges and in the result it received unfounded income for 148.4 million soums.

The committee’s special commission issued order to Avtooyna to end violation of the Law “On limiting monopoly activity at goods market and competition” and pay a fine to budget for violation of norms of order, approved by the Cabinet of Ministry (high fixed and maximum prices and extra charges), at the size of 20% of unfounded income or 29.7 million soums.

Avtooyna OJSC did not agree with the decision of Special commission and appealed to the Economic Court. The writ was considered at the court of the first instance, Court of Cassation and Court of Appeal. However, the decision of the commission was found as legal and the appeal of the enterprises was rejected.
