Arbitration Development Center holds seminar
Tashkent, Uzbekistan (UzDaily.com) -- On 2 December 2009, Arbitration Development Center under the Chamber of Commerce and Industry of Uzbekistan jointly with the UNDP "Business Forum of Uzbekistan" Project and Legal Clinic under the University of World Economy and Diplomacy held seminar titled "Constitutional fundamentals for the entrepreneurs` rights protection", dedicated to the 17th anniversary of the Constitution of the Republic of Uzbekistan.

The Constitution of the Republic of Uzbekistan, recognizing the primacy of generally recognized norms of international law and setting forth the task of creation of democratic legal state, created the basis for the application of different methods of dispute settlement among business entities. Today along with considering disputable cases in state courts, in particularly, the practice of using alternative methods of dispute settlement, including arbitration proceedings is implemented.

One of the basic principles of the democratic society is having right of choice. Adoption of the Law of the Republic of Uzbekistan "On arbitration courts" ensures the right of every businessman to choose the order in which to settle the dispute: whether to apply to state courts or to arbitration courts to resolve certain types of dispute settlement.

The main purpose of this event was to attract attention of participants to one of the most popular methods of dispute settlement today - arbitration, as well as get acquainted with its features and prospects of further development. Participants of this event were students of legal clinics under higher educational institutions that provide free legal services to the public. The event was opened by Z.Ubaydullaev, Deputy of the Legislative Chamber of Oliy Majlis of the Republic of Uzbekistan and D.Ahmatov, Head of Department of legal expertise and legal protection of entrepreneurship of the Chamber of Commerce and Industry of the Republic of Uzbekistan.

The seminar provided information on arbitration courts, formed under the territorial departments of the Chamber of Commerce and Industry, their achievements over 3 years of existence, and the nature of the arbitration proceeding in Uzbekistan. In addition, practitioners got acquainted with detailed analysis of the grounds for discharge of a court order of arbitration courts by competent courts. The final part of the workshop consisted of the role-playing and case studies, during which students fastened and tested their knowledge gained during the seminar.
