Amendments and additions have been made to the Civil Procedure Code

Tashkent, Uzbekistan (UzDaily.com) -- The law signed by the President introduced changes and additions to the Civil Procedure Code.

The law introduced the stage of reviewing cases in regional and equivalent courts.

The procedure for higher courts to send overturned decisions of lower courts back to these courts for a new consideration has been eliminated.

Each court has the responsibility to make a final decision in the case.

Also, a private complaint (protest) may be filed against a court ruling to refuse to cancel a court order.

A private complaint (protest) may be filed against a court decision to refuse to accept an application for processing. In case of cancellation of the ruling, the application is considered filed on the day of the initial application to the court.

The ruling or resolution of the court of appeal, cassation and revision shall enter into legal force immediately after its adoption.

A complaint (protest) may be filed in the audit procedure against a decision, ruling, or resolution of a court of first instance considered in an appeal or cassation procedure and against a ruling of a court of appeal or cassation.

A complaint (protest), subject to review by the Judicial Collegium for Civil Cases of the Court of the Republic of Karakalpakstan, regional and Tashkent City Courts, and the Military Court of the Republic of Uzbekistan, is addressed to these courts, but is submitted to the court of first instance that adopted the judicial act.

A complaint (protest), subject to review by the Judicial Collegium for Civil Cases of the Supreme Court, is submitted directly to the Judicial Collegium for Civil Cases of the Supreme Court.

A protest in the revision procedure of the Chairman of the Supreme Court, the Prosecutor General to the Presidium of the Supreme Court is submitted directly to the Supreme Court.

A complaint (protest) in the audit procedure is filed within one year from the date of entry into force of the decision, ruling, resolution of the court of first instance.

The law comes into force on 1 January 2024.
