A new procedure for pre-trial consideration of administrative acts related to public services to be introduced

Tashkent, Uzbekistan (UzDaily.com) -- A new procedure for pre-trial consideration of administrative acts related to the provision of certain public services will be introduced in Uzbekistan. 

This is envisaged by the Presidential Decree “On further increasing responsibility and forming a compact management system of justice bodies and institutions within the framework of administrative reforms.”

According to the document, in the period from 1 July 2024 to 1 July 2026, a legal experiment will be conducted in Tashkent to introduce a new procedure for pre-trial consideration of administrative acts relating to the provision of public services that do not comply with the law.

To conduct the experiment, a Supreme Appeal Council will be created under the Ministry of Justice and an Appeal Council under the Justice Department of the city of Tashkent. These councils will engage in pre-trial consideration of administrative acts related to public services and make decisions to change or cancel such acts, except in cases where cancellation or change is possible only through the court.

The appeal councils will consider acts based on complaints from interested parties and the results of monitoring the provision of public services. Their decisions will be published in the electronic system “E-qaror” and brought to the attention of participants in the administrative process. The execution of decisions of appeal boards will be mandatory for administrative bodies.

Decisions of the appeal boards can be appealed in court by interested parties, but for administrative bodies they will be final and not subject to appeal.
