Tashkent, Uzbekistan (UzDaily.com) -- In the context of the coronavirus pandemic, the issue of employment is an acute issue in many countries of the world. When many companies and concerns are cutting their thousands of employees, finding a place on the labor market is one of the important problems that concern the world community. What will be the situation after the pandemic, how will the economy recover? These questions are difficult to answer and cannot predict anything concrete, even well-known experts. So it is necessary to revise the legal documents on labor relations.
Deputies of the lower house of parliament are preparing for second reading the draft law “On Amendments and Additions to the Law of the Republic of Uzbekistan“ On Private Employment Agencies”.
The document is discussed during the meetings of the working group of the Committee of the Legislative Chamber on innovation development, information policy and information technology, held in a video conference format with the participation of experts and specialists in the field. Actual questions on employment are raised, factions of political parties come up with their proposals, each norm is considered by members of parliaments based on the interests of the people.
The Law on Private Employment Agencies was passed two years ago. Why do deputies propose amendments to it?
“Since 2018, with the adoption of the document, private employment agencies began their activities,” says Inomjon Kudratov, member of the Committee for Innovative Development, Information Policy and Information Technology. “They provide services to citizens who want to find jobs outside of Uzbekistan on a paid basis.” Many found a job, but some, trusting the agencies lost a lot of money, remained out of work in foreign countries. Everyone remembers the sensational story in the media and social networks of more than seven thousand citizens to whom private agencies caused damage in the amount of 72 billion soums. Criminal proceedings were instituted against their leaders, and money was returned to compatriots. But to prevent such a situation, amendments should be made to the current law. Namely, the lack of authority on the part of the licensing authority to verify the activities of private employment agencies leads to significant material damage caused by deception and abuse of citizens' trust.
The current law does not define the obligations of private agencies in relation to job seekers, and does not establish control over their activities.
Therefore, certain articles of the draft law are amended and supplemented. The bill improves the system of employment of citizens abroad, introduces a mechanism for paying the cost of employment services for people seeking work outside the Republic of Uzbekistan at the expense of a foreign employer, and determines the definition of the reserve amount in the amount of 8,500 basic calculation values. Thus, a reserve obligation of 1 billion 895 million 500 thousand soums or 200 thousand dollars increases the responsibility of a private employment agency.
The document also determines the specific amount of payment for the provision of information and consulting services by private employment agencies. In order to ensure transparency of activities, contracts for the provision of real-time services will be registered in the Labor-migration software package of the Ministry of Employment and Labor Relations.
It is noteworthy that the bill is supplemented by a norm on the creation of an information exchange system for those who are looking for work abroad, so that, if necessary, contact the competent authorities. The document gives the Ministry of Labor and Labor Relations the authority to review the work of private employment agencies without interfering in their financial and economic activities.
Thus, a database will be created on citizens seeking work abroad, their future fate, the market for high-income jobs abroad will be settled, information about jobs in our country will be provided, and cases of abuse of citizens' trust by private employment agencies will be prevented.
Work on improving the draft law is continued by committee members, after which it will be considered at the second reading at a meeting of the Legislative Chamber of the Oliy Majlis.
