Tashkent, Uzbekistan (UzDaily.com) -- On 27 July, an expanded meeting of the collegium of the Ministry of Justice was held. The meeting chaired by Justice Minister Ruslanbek Davletov discussed the results of the work done by law enforcement agencies and institutions in the field of lawmaking and law enforcement in the first half of 2019, the execution of decrees and resolutions of the head of state aimed at further improving the activities of justice authorities.
The event in the form of video conferencing was attended by the heads and senior officials at all levels of the bodies and institutions of justice.
During the meeting, Justice Minister Ruslanbek Davletov drew the participants’ attention to one of the most pressing issues of today - the demolition of residential buildings, stressing that every employee of the judiciary must define it for himself as a priority.
During the period of large-scale transformation in accordance with the Strategy of Action, the whole republic turned into a large construction site. Works on construction and reconstruction, changing the appearance of cities and regions of the country are accompanied by the withdrawal of land for state and public needs, demolitions of residential and non-residential objects. However, these processes do not always occur within the framework of current legislation, which leads to an increase in citizens’ discontent and reduced public confidence in the government.
According to the Minister of Justice, the judicial authorities three months ago, before this problem of demolition became so large-scale, began its studies and began to take action. In particular, the Ministry of Justice announced the holding in May — June 2019 of an action to receive and consider online applications in the area of respect for citizens’ rights to real estate. Within the framework of the campaign, 874 cases of violation of the law were revealed when considering appeals. Justice authorities made 236 submissions to the relevant organizations, 100 warnings, and 360 claims for 30.3 billion soums were made to the courts. Of course, these results are just a drop in the ocean. Workers of the justice system should understand the seriousness of this issue, understand that taking measures against violation of legislation in this area is our top priority, Ruslan Davletov stressed.
At the meeting, it was noted that employees of the judicial authorities should realize the seriousness of this situation, take measures against violation of the law in this direction. The key task of each judicial authority should be to fulfill the instructions of the head of state to ensure the rule of law in society.
“There is not a single economically developed state in the world in which the inviolability of property would not be ensured. The inviolability of property is one of the highest standards enshrined in our legislation, and all relationships are fully settled. However, in practice, officials forget about these rules and procedures. As a result, the rule of law in housing issues has been seriously affected,” the Minister added.
- What does it mean? Throwing people on the street, destroying their homes and not paying compensation, is barbarism, Ruslan Davletov continued. - This is wrong from the point of view of legislation, as well as from the point of view of universal human values. This does not correspond to the international documents to which Uzbekistan joined and recognized.
According to the minister, all cities are being rebuilt, dilapidated buildings are being demolished, landscaping is underway, this is a natural process that is peculiar to all societies. However, for all actions, persons living in the XXI century as a civilized society, the highest value should be the law. It is unacceptable to carry out construction or improvement by violating human rights, by violating the law.
“In this regard, the primary task of the judiciary, us, is to prevent violations of the law. Every employee should feel with his heart how serious the problem of housing demolition is, that is, to present themselves and their children in the place of these people, nothing more is needed, ” the Minister of Justice noted.
“Pay attention to one more aspect,” Davletov continued. - The question is not only in the building, material wealth. After all, with the demolition of housing erased and memories associated with the house. The place where he was born and grew up, the yard where he played as a child, childhood memories, even the unique smell of the house - all this is expensive for each person. Many houses are handed down from generation to generation; this is a high personal intangible wealth and inseparable from the life of a person.
Proceeding from the problems encountered in practice, the opinions and proposals expressed, the Minister of Justice emphasized the priorities that confront the justice officials. In particular, it was noted: “We demand from all local khokimiyats to stop violating the legal rights of citizens, including the right to property. I urge all managers, commissioners and employees of the justice system to take measures to ensure the implementation of the laws of Uzbekistan in the process of demolishing housing, using all their powers.”
