Draft law on protecting property rights developed in Uzbekistan

Tashkent, Uzbekistan (UzDaily.com) -- A draft law was developed in Uzbekistan, which is aimed at prohibiting confiscation of property used as an instrument of crime in the absence of the culpability of its owner in committing a crime, the press service of the Ministry of Justice of Uzbekistan said.
According to the document, instruments of the crime, belonging only to the participant in the crime, will now be confiscated.
The document will also prohibit confiscation of property, which is not the property of the person who committed an administrative offense.
Now, according to article 211 of the Code of Criminal Procedure, instruments of crime, regardless of their belonging, are confiscated and transferred to relevant institutions or destroyed.
In accordance with this rule, property, which is an instrument of a crime is confiscated regardless of the participation of its owner in commission of the crime, whether he is an accomplice, suspect, accused, defendant or convicted.
The draft law will ensure the guarantee of private property and strengthen protection of property rights, as well as the prevention of confiscation of property of persons, who did not commit crime.
The government of Uzbekistan approved a draft law, which was developed by the Ministry of Justice. At present, the document is considered at the Legislative Chamber of the Oliy Majlis.
