Tashkent, Uzbekistan (UzDaily.com) -- A draft law “On Mediation” was developed in Uzbekistan. The draft law was published on the portal for discussion of normative legal acts.
Mediation is conducted on the basis of the principles of legality, voluntariness, confidentiality, cooperation and equality of parties, independence and impartiality of the mediator, the draft law says.
To conduct mediation, it is necessary that the parties have the ability to freely express their opinion, including to discuss ways of mutually acceptable resolution of the dispute. Coercion for reconciliation in the mediation process is prohibited, the document says.
Mediation participants are not entitled to disclose information, which became known to them during the mediation, without the written consent of the side of the mediation, which provided this information, its successor or representative.
The mediator cannot be questioned as a witness about the information, which has become known to him/her during the mediation, except in cases envisaged by the law.
The participants in mediation are the sides and the mediator. The parties in the mediation process can be both individuals and legal entities, including state bodies and organizations.
Mediation can take place between two or more parties, and also be conducted by one or more mediators.
The parties participate in the mediation process personally or through their representative in accordance with the law.
The draft law establishes the rights of duties and responsibilities of the mediator, participants in mediation, as well as the procedure for mediation.
