UzLiDeP MP: the law protects private property

Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Islam Karimov signed a decree “On measures on ensuring reliable protection of private property, small business and private entrepreneurship, eliminating barriers for their fast development” on 15 May 2015.
Atham Nazirkulov, Member of UzLiDeP faction in Legislative Chamber of Oliy Majlis of Uzbekistan, commented the decree:
UzLiDeP deputies in their work pay attention to ensure the legislative processes of economic liberalization, the introduction of market principles and mechanisms of governance, a favorable business climate, removing unnecessary bureaucratic barriers and obstacles to the development of private property and private enterprise.
In this context, the Decree of the President of the Republic of Uzbekistan “On measures on ensuring reliable protection of private property, small business and private entrepreneurship, eliminating barriers for their fast development” contains a large amount of the forthcoming legislative work. First of all, it concerns our UzLiDeP faction because the above mentioned rule fully meets the needs and interest of party electorate.
UzLiDeP conducted a comprehensive analysis of the decree and realized that it is directed at raising responsibility of officials of state, controlling and law enforcement bodies for illegal interference to activities of private businesses. It also envisages strengthening guarantees for protection of private property, liberalize administrative and criminal legislations, regulating business activities.
In the new edition of the Law "On state control of business activities" will need to include the norm on correcting mistakes for business entities during audits as well as controlling bodies should conduct preventive work aimed at improving the legal literacy of entrepreneurs before comprehensive audits of their activities.
Deputies of the faction UzLiDeP also will participate together with organizations in the elaboration and adoption of specific measures to increase the responsibility of officials of state, controlling and law enforcement bodies for illegal interference to activities of private businesses. Moreover, officials who repeatedly violate the law in the protection of freedom of entrepreneurship will be applied criminal sanctions.
All of these amendments should be reflected in the administrative and criminal law.
In particular, according to a new order, the criminal case is not initiated and the person is released from liability if he has committed a crime under Article 184 of the Criminal Code (evasion from payment of taxes or other mandatory payments), and fully compensates the damage caused to the state, pays fines and other financial penalties within 30 days after the discovery of the crime.
It is also planned to amend the Criminal Code, under which the penalty is not applied in the form of imprisonment, in case of full compensation of material damage for officials of economic entities provided for false bankruptcy and concealment of bankruptcy.
UzLiDeP faction believes that the introduction of changes and amendments to existing legislation will perform a logical step on the way of legislative support of further deepening democratic reforms and market liberalization, economic restructuring, the extensive development of small business and private entrepreneurship.
